COMPREHENSIVE REFUND, RETURNS, AND HARDWARE WARRANTY POLICY

Effective Date: October 5, 2026 Governing Entity: CaliClear LLC ([https://caliclearllc.com](https://caliclearllc.com)) Returns & Warranty Department: sales@caliclearllc.com

Due to the highly sensitive, consumable, and heavily regulated nature of refined botanical distillates and electronic inhalation hardware, CaliClear LLC operates under an uncompromising and rigid Refund and Returns framework. This policy is explicitly engineered to guarantee absolute biological safety, prevent product tampering, protect our supply chain from cross-contamination, and maintain full compliance with public health directives and federal vaporizer distribution laws.

By executing a transaction on the CaliClear LLC digital platform, you legally bind yourself to the stipulations detailed within this document.

1. The Strict Non-Returnable Provision (Consumables)

To preserve the sanitary integrity of our inventory and protect our end-users from potential biological or chemical contamination, CaliClear LLC categorically refuses the return, exchange, or refund of any consumable product that has been opened, unsealed, or manipulated in any manner.

  • Tamper-Evident Seals: All CaliClear LLC distillate products, cartridges, and disposable systems are secured using medical-grade blister packaging, shrink-wrap, and holographic tamper-evident seals. Any breach, tear, or microscopic alteration of these seals immediately and permanently voids return eligibility.

  • Subjective Dissatisfaction: The physiological and psychoactive effects of cannabinoids, as well as the perception of native terpene profiles, vary wildly across individual human biochemistries. Therefore, we do not accept returns based on subjective preferences. This includes, but is not limited to: distaste for specific botanical flavor profiles, dissatisfaction with the velocity of psychoactive onset, or misunderstandings regarding the chemical potency specifications listed on the product’s Certificate of Analysis (COA).

  • Clearance and Flash Sales: All products acquired during promotional events, flash sales, or marked as “Clearance” are considered final sale. No returns or exchanges will be processed for these items under any circumstances, barring a verified Dead-on-Arrival (DOA) hardware failure.

2. Time-Restricted Return Eligibility (Unopened Merchandise)

Should a client need to return a product due to an erroneous order placement prior to fulfillment processing, or if an incorrect, factory-sealed item was inadvertently shipped by our fulfillment center, the following rigorous parameters apply:

  • The 14-Day Window: You may request a formal return authorization within Fourteen (14) calendar days of the confirmed delivery date, as logged by the courier’s tracking manifest. Requests initiated on day 15 or later will be automatically rejected.

  • Pristine Condition Mandate: The product must remain in its pristine, factory-sealed condition, entirely free from physical damage, thermal exposure, or environmental degradation.

  • Restocking and Quality Assurance Fee: All authorized, non-defective returns are subject to a mandatory 20% Restocking and Quality Assurance Fee. This fee subsidizes the labor-intensive process of re-verifying the chemical and physical integrity of the returned goods before they can legally be reintroduced into our clean-room inventory.

  • Financial Liability for Transit: The consumer bears absolute financial responsibility for all return shipping logistics. We strongly mandate the use of insured, trackable courier services for all returns. CaliClear LLC is not liable for returned parcels lost or intercepted in transit. Original shipping surcharges, including Adult Signature Required (ASR) fees and route insurance premiums, are strictly non-refundable.

3. Comprehensive Hardware Warranty and DOA Protocol

CaliClear LLC acknowledges that microscopic mechanical anomalies can occasionally manifest within complex micro-electronic vaporization systems, despite rigorous ISO-certified quality assurance testing. We offer a highly structured, 72-Hour Dead-on-Arrival (DOA) Warranty specifically governing defective hardware.

3.1 Qualifying Hardware Defects

The DOA warranty covers critical manufacturing failures that render the hardware wholly inoperable immediately upon unboxing. Qualifying defects are strictly limited to:

  • Catastrophic cartridge leakage into the primary packaging prior to initial use.

  • Total internal battery failure (inability to hold a charge or illuminate the LED indicator).

  • Internal circuitry short-circuiting preventing the aerosolization of the distillate.

  • Non-functional ceramic atomizers (failure to heat the element despite adequate battery voltage).

3.2 Explicit Warranty Exclusions

The hardware warranty is instantaneously voided if the malfunction is determined by our diagnostic technicians to be the result of user error, negligence, or environmental abuse. Exclusions include, but are not limited to:

  • Thermal and Viscosity Abuse: Clogging resulting from failure to clear the vapor path post-inhalation, or exposing the hardware to extreme environmental temperatures (e.g., leaving a cartridge in a hot vehicle, causing the oil viscosity to thin and flood the atomizer chamber).

  • Voltage Overload: Utilizing unregulated, high-voltage aftermarket batteries or rapid-charging blocks (exceeding 1.0 Amp output), which permanently scorches the delicate ceramic heating matrix.

  • Physical Trauma: Micro-fractures to the borosilicate glass or internal thread stripping caused by dropping the device or cross-threading the 510-connection point.

  • Post-Consumption Claims: We do not warrant hardware that has been partially or fully depleted. Warranty claims must be made before 10% of the total distillate volume has been consumed.

4. The Return Merchandise Authorization (RMA) Process

CaliClear LLC operates a highly restricted receiving department. Attempting to return restricted botanical or electronic products without prior corporate authorization will result in the immediate classification of the package as “Hazardous Unknowns,” leading to its destruction by our receiving department, with no refund issued to the sender.

To initiate a legally compliant return or warranty claim, you must adhere strictly to the following RMA protocol:

  1. Draft a Formal Claim: Transmit an email to sales@caliclearllc.com within the applicable timeframe (72 hours for DOA, 14 days for unopened goods). Include your full legal name and the complete alphanumeric Order Number.

  2. Provide Substantiating Documentation:

    • For Unopened Returns: Attach high-resolution photographic evidence demonstrating all angles of the intact, unaltered packaging seals.

    • For Defective Claims: Attach a detailed written diagnostic of the failure, accompanied by high-resolution photographic or video evidence clearly demonstrating the specific hardware malfunction (e.g., a video showing the battery blinking an error code when attached to a charger).

  3. RMA Issuance: Upon verification by our compliance team, you will be issued a unique Return Merchandise Authorization (RMA) code and a set of secure shipping instructions.

  4. Transit Protocol: The authorized RMA number must be prominently inscribed on the exterior of the return parcel. Packages lacking a visible, verified RMA number will be rejected at the loading dock.

  5. Diagnostic Inspection: Upon receipt, our technical staff will subject the hardware to a full diagnostic teardown to verify the defect. If the claim is validated, a replacement unit will be dispatched, or a localized refund will be issued to the original payment terminal within 7 to 10 business days. If the diagnostic reveals user error, the claim will be denied, and the hardware will be destroyed.

5. Chargeback Fraud and Financial Disputes

CaliClear LLC maintains a militant, zero-tolerance policy regarding chargeback fraud, “friendly fraud,” or the falsification of financial disputes through payment gateways.

  • Due to the stringent regulatory nature of our operations, every transaction requires extensive IP logging, biometric or document-based age verification, and an Adult Signature Upon Delivery (ASR). We retain exhaustive digital and physical records proving the transfer of goods.

  • In the event of a fraudulent chargeback filed with a financial institution (e.g., claiming “Item Not Received” despite a verified ASR signature on file), CaliClear LLC will immediately deploy our legal counsel to forward all tracking data, signature confirmation, ID verification records, and network telemetry logs to the presiding bank to aggressive contest the dispute.

  • Individuals found engaging in documented chargeback fraud will be permanently blacklisted from the [https://caliclearllc.com](https://caliclearllc.com) infrastructure, their details will be submitted to centralized e-commerce fraud prevention databases, and we reserve the right to pursue civil litigation to recover stolen assets, legal fees, and administrative costs.
