COMPREHENSIVE LOGISTICS AND SHIPPING COMPLIANCE POLICY

Effective Date: October 5, 2026 Governing Entity: CaliClear LLC ([https://caliclearllc.com](https://caliclearllc.com)) Logistics & Dispatch Operations: sales@caliclearllc.com

The transportation, distribution, and interstate commerce of THC vaporization hardware and concentrated botanical distillates involve navigating a highly volatile and deeply complex matrix of federal postal regulations, localized state laws, and stringent private carrier requirements. CaliClear LLC has engineered a rigorous, multi-tiered shipping infrastructure designed to ensure all parcels are dispatched and delivered securely, legally, and expediently, while maintaining the chemical integrity of the payload.

By executing a transaction on the CaliClear LLC digital platform and finalizing the checkout process, you legally consent to the exhaustive logistical parameters and liability allocations detailed within this document.

1. Order Processing, Fraud Screening, and Dispatch Matrix

The journey of a CaliClear LLC package begins long before it is transferred to a courier. We utilize a highly regimented fulfillment protocol to ensure accuracy, legal compliance, and security.

  • Algorithmic Fraud Screening: Upon checkout, every transaction is immediately routed through our automated, AI-driven fraud detection gateway. Orders flagged for severe IP/Billing address mismatches, rapid successive purchasing attempts, or suspected proxy usage will be placed under a mandatory 48-hour manual review hold. If the transaction fails manual verification, it will be immediately voided and reported.

  • Standard Processing Timelines: Orders successfully subjected to our fraud screening and manual age-verification checks are typically processed and packaged within 24 to 72 business hours.

  • Operating Hours: The CaliClear LLC central fulfillment laboratory and logistics center operates Monday through Friday, 9:00 AM to 5:00 PM Eastern Standard Time (EST). Operations, including dispatch and carrier pickups, are strictly suspended on Saturdays, Sundays, and all recognized federal U.S. holidays (e.g., USPS postal holidays).

  • Tracking Allocation and Telemetry: Upon the physical generation of the shipping manifest and thermal label, a unique alphanumeric tracking nomenclature is automatically transmitted to the client’s registered email address. Please allow a standard latency period of up to 24 to 48 hours for the carrier’s localized scanning databases to reflect the initial transit event.

2. The Prevent All Cigarette Trafficking (PACT) Act and Mandatory ASR Protocol

In absolute compliance with the Prevent All Cigarette Trafficking (PACT) Act, the Jenkins Act, and subsequent federal amendments regulating the postal shipment of Electronic Nicotine Delivery Systems (ENDS) and botanical vaporizers, CaliClear LLC operates under a heavily restricted delivery mandate.

Every single order dispatched by CaliClear LLC requires a legally binding Adult Signature Required (ASR) protocol upon delivery.

  • Absolute Prohibition on Unattended Delivery: Under federal law, the courier (whether USPS or a compliant private regional carrier) is strictly prohibited from leaving the parcel unattended on a porch, inside a standard mailbox, with a neighbor, or with any individual under the age of 21.

  • Point-of-Delivery Verification: The receiving party must be physically present at the time of delivery and must present a valid, unexpired, government-issued photographic identification (e.g., Driver’s License, Passport, State ID) to the delivery agent. The agent will physically or electronically verify the recipient’s age before surrendering the parcel.

  • Failed Deliveries and Financial Penalties: Couriers will typically attempt delivery a maximum of two (2) to three (3) times. If an adult (21+) is unavailable to sign for the package after the final attempt, the parcel will be classified as “Undeliverable” and routed back to our processing facility.

  • Liability for Failed ASR: If a package is returned due to a failed adult signature, the customer will be held entirely financially liable for the original shipping costs, the return shipping penalties levied by the carrier, and a mandatory 20% Restocking Fee to process the inventory back into our secure facility. Re-shipment of the order will require the repayment of the full ASR shipping rate.

3. Jurisdictional Restrictions, Geofencing, and Embargoed Territories

The legislative environment concerning THC, hemp-derived isomers, and high-concentration cannabinoids is highly fragmented and subject to immediate, unannounced regulatory shifts. What is legal in one county may be heavily penalized in an adjacent municipality.

  • Dynamic Geofencing: CaliClear LLC utilizes advanced, real-time geofencing software integrated directly into our checkout architecture. This system references an actively updated legal database to restrict sales to compliant jurisdictions.

  • Right of Refusal: We explicitly reserve the sovereign right to void, cancel, and fully refund any transaction originating from—or destined for—a zip code where local statutes, county ordinances, or state laws prohibit the importation, possession, or distribution of our specific chemical profiles or hardware configurations.

  • Absolute Prohibition on International Shipping: Due to the severe federal penalties associated with international customs law, international drug enforcement treaties, and complex biomedical import tariffs, CaliClear LLC strictly limits its operational distribution to the domestic United States. We do not export products, nor do we ship to freight forwarders intended for international export, under any circumstances. Orders flagged as utilizing international freight forwarders will be immediately canceled.

4. Environmental, Climatic, and Altitude Considerations in Transit

Botanical distillates and precision-engineered vaporization hardware are highly sensitive to extreme environmental fluctuations occurring within standard courier transit networks.

  • Thermal Expansion and Viscosity: Leaving packages in extreme heat (e.g., inside a hot postal vehicle or un-airconditioned sorting facility during summer months) can cause the oil viscosity to thin significantly. This temporary physical change can lead to minor hardware flooding or require the user to allow the cartridge to return to room temperature before utilization. Conversely, extreme cold can hyper-thicken the distillate, requiring the user to properly prime and gently warm the coil prior to aerosolization to prevent dry-burning the ceramic core.

  • Barometric Pressure Anomalies (Air Transit): Parcels routed through air-cargo networks are subjected to rapid shifts in atmospheric pressure. While our hardware is sealed using pressure-fitted, medical-grade gaskets, extreme barometric shifts can occasionally force trace amounts of distillate into the central vapor path.

  • Waiver of Liability: By purchasing from CaliClear LLC, you acknowledge these physical realities of transporting biochemical liquids. CaliClear LLC is not liable for minor product degradation, slight viscosity shifts, or required user-end maintenance resulting from prolonged exposure to adverse weather, thermal shock, or altitude shifts post-dispatch.

5. Title, Risk of Loss, and Transit Insurance Protections

The legal title, ownership, and inherent risk of loss for all purchased goods transfer irrevocably from CaliClear LLC to the consumer the exact moment the parcel is physically transferred to and scanned by the courier service (FOB Origin).

  • Porch Piracy and Post-Delivery Theft: CaliClear LLC’s legal and financial liability terminates upon the carrier logging a successful delivery scan (which, due to ASR protocols, requires an adult signature). We are not legally or financially liable for packages that are stolen from the premises after being successfully signed for, or if the consumer authorizes a proxy to sign on their behalf who subsequently misplaces the goods.

  • Route Package Protection (Highly Recommended): Given the high monetary and subjective value of our shipments, we strongly advocate for the utilization of Route Package Protection (or an equivalent third-party shipping insurance offered at checkout). If this premium is elected and paid, your order is financially safeguarded against transit loss, severe physical destruction by the carrier, or catastrophic logistics failure prior to delivery. If a customer manually opts out of transit insurance at checkout, they assume 100% of the financial risk for goods lost or destroyed by the courier.

6. Law Enforcement Interception and Postal Audits

Because our products contain botanical distillates that share a visual and olfactory profile with strictly controlled substances, shipments are occasionally subjected to random audits by the United States Postal Inspection Service (USPIS) or equivalent carrier regulatory bodies.

  • Compliance Documentation Inclusion: To preemptively address these audits, CaliClear LLC includes a comprehensive “Notice to Law Enforcement” and a digitally verifiable Certificate of Analysis (COA) directly within every single shipping parcel. This documentation proves the federal legality (e.g., Farm Bill compliance, where applicable) of the enclosed shipment.

  • Transit Delays Due to Audits: If a parcel is temporarily detained for chemical field testing by postal inspectors, CaliClear LLC cannot be held responsible for the resulting transit delays. We will, however, fully cooperate with any official inquiries to expedite the release of your legally procured goods.
